There are several types of agency agreements and they all set out the terms of the agreement between yourself (the Vendor) and the agent. The Department of Fair Trading within your state has up to date definitions of each agency and explanations of each. All agencies will boil down to either exclusive,open or auction and in any case an Auction agreement implies an exclusive agreement ( could also be joint exclusive ) Exclusive Agreements mean that you can still sell your own home but if you do you will do so under pain of commission...in other words the agent will still have cause to still claim his commission. An exclusive agency gives selling rights to one agent for a period of time ( often 3 months ) A joint exclusive is similar but the selling rights are granted to several agencies with a written agreement to either share commissions, or on a winner take all basis, between the chosen agencies. Joint exclusive agencies are most commonly between a buyer and two real estate agencies. Joint agencies are somewhat rare and like all agency agreements there are pros and cons. Likewise there are both advantages and drawbacks to using an Open agency when selling. Open agencies allow a seller to enlist a number of agencies to sell a property on a winner take all basis. Certainly most agents resist open, or multi listing, of their properties for sale. Suburb reports with historical sales data are a great help but so is a studied examination of newspaper and intenet ads within your local real estate area. What do I need to sell my property? Every state of Australia has slightly differing requirements when it comes to selling with an agent or DIY selling. If you list with an agent and employ his services in the capacity of salesman you must sign an agency agreement and the agent must hold a contract in his office. Please note that the contract is not the agency agreement. The contract is the legal and binding document that both buyer and seller will adhere to during the real estate transaction. An agency agreement is what sets out the terms of the agents "commission" with you the seller. Private sellers also require a contract and that contract is obtainable from the Solicitor or Conveyancer of your choice.
